Millons of over billing to the Summit Creditors, 15% Commission on all sales, though GOOD for him and not necessarily the Creditors.. , andObsidian Finance Group, LLC and Kevin D. Padrick is still abusing the Oregon Courts to Control the Truth about Obsidian Finance Group, LLC and Kevin D. Padrick .. Hmmmm..

... and are the Summit 1031 Creditors Paying for this Lawsuit against the "Media" - against Investigative Blogger Crystal L. Cox... ???

Did Obsidian Finance Group, LLC and Kevin D. Padrick sue the Bend Oregon Newspapers, or the Portland Newspapers for what they Wrote on the Summit 1031 Bankrupcty or is this more of Obsidian Finance Group, LLC and Kevin D. Padrick woman hating, discrimination rearing up... as with the 2 year harassment and criminal charges against Oregon CPA and Oregon Bankruptcy Whistleblower Stephanie DeYoung FOR Her Exposing the Financial Facts and Details of Obsidian Finance Group, LLC and Kevin D. I mean can you really even use local cops and district court to take ANY action at all against a Blog, youTube Videos or anything on the internet Really?

Unless of Course it is as Serious as a Death Threat, and Well I know full well that Local Law will DO NOTHING about that... so District Court is then seemingly involved in Doing Dirty Deeds for Attorneys so they can throw their CLOUT around and bully people into doing what benefits them... problem is Stephanie DeYoung does know her rights, and though the Bend Courts may violate those rights and may act a bit outside of the actual law and their Internet jurisdiction ...

Have You Ever "Objected" to Outrageous Attorney Fees?

Have you ever done this formally with an actual legal complaint? Most simply are just outraged and really are Powerless at the Over Charging, Bullying and lack of real action and True Justice that Attorneys serve up, however, even in the face of extreme ridicule and harassment this One Woman had the Moxy to Object to HUGE - Out of Line Attorney fees in a High Profile - High Dollar Bankruptcy Case. Stephanie DeYoung was not paying this money out of her pocket, and well it turns out nothing to do with her inheritance as well... it is Creditors money, spread as a loss over all of YOUR pocket books and blamed on 'The Bankruptcy Just Costs that..' but you would have to be a Bankruptcy Attorney to Know That... and this cost is also blamed on the Principals Yet that Money was there and SHOULD have WENT to you the Creditors and not the Attorneys, the United States Bankruptcy Trustee should have seen to that immediately INSTEAD of letting some Middle Guy take Millions from YOU on their Watch ... it is Not Fair, Right, or in any way Moral.. but it looks like in the Oregon Bankruptcy Court system and the US Dept. of Justice Trustee System.. it Certainly MUST be Legal.

Stephanie DeYoung Spoke out about Millions in ... Well Too High of an Attorney Bill that would continue that high rate for up to 5 years I believe... this Woman, this Whistleblower Said I Object, and she Really Was Doing the Right thing With this Objection... however with that She was Tormented, Harassed, and well.. her life changed forever...

Three years before Bend's Summit 1031 Exchange filed for bankruptcy, Lane Lyons, then an employee of the now defunct real estate services company, raised a red flag about the business in an e-mail to fellow employee Timothy Larkin.

The Obvious question HERE is 3 Years AGO, Lane Lyons and Timothy Larkin Raised a RED FLAG to each other in Secret, and did not tell authorities, did not leave the Summit 1031 Exchange Company, did not Contact the IRS, and seemingly did NOTHING to HALT the Future Major Loss to Innocent Real Estate Victims???

How much money did Lane Lyons and Timothy Larkin make during this time, who benefited from their money, where is there accountability? Not to mention the Major Moral and Ethical Issue that is Raised with this.

If they are now bankrupt and have NOTHING... well then I guess no one is accountable right? So if there is no Money to Protect, then WHY are these supposed eMails surfacing now?

Who gave this information to the Bend Bulletin?

If these Red Flag Emails were part of the case long ago then What Purpose do they serve to unleash on the Bend Oregon Residents Right Now ????

Why did this Email even Surface? Was it to make Lane Lyons and Timothy Larkin look like they tried to STOP all this? Or to make them look like they are really, really bad because they did not stop it ?

Both Lyons and Larkin would become principals in the company in 2006.

The e-mail, quoted in the bankruptcy trustee's report, indicates Lyons' concern about a company called Inland Capital Corp., which the trustee's report asserts was created by Summit's two original shareholders — Mark Neuman and Brian Stevens — for the express purpose of loaning money from Summit to Inland for the personal gain of the shareholders, their families and friends, primarily through investment in Central Oregon real estate.

Because if it is... the Department of Justice, the FBI, and ALL authorities involved had better NOT Discriminate in this Case and they had better look into ALL the other 1031 Exchange Companies to see if this Truly is a "Standard of Practice" among most or ALL 1031 Exchange Companies.

Personally I feel it is wrong for a 1031 Exchange Company to get to use a Real Estate Consumers Money for 6 months INTEREST free to do whatever they like.... and YES part of that USE is quite often Real Estate Investments.. especially at a TIME when that was the Biggest Return...

That Happened in Northwest Montana as Well... with Companies Other then Summit 1031... as a Real Estate Broker - Owner I Know... and I have had many Real Estate Sellers Choose NOT to do a 1031 Exchange because of this... I imagine that it happens in many other states and areas as Well.

So to Defame, Discredit, Harass and point the alleged Criminal Finger of Blame at the Principals of the Summit 1031 Company and their "Family and Friends" and to single them out, is not only immoral and unEthical but it is NOT based in Law, Justice, Fact and TRUTH in any way.

The Biggest BLAME Should be on the IRS -and the IRS should STEP up and PAY the REAL Estate Victims RIGHT NOW for their Oversite and mishandling of the ENTIRE 1031 Exchange Industry...

there is NONE or not enough Regulation over the 1031 Exchange Industry, so to Blame those who owned the company for Doing Business as Usual is NOT right.

the 1031 Exchange Industry NEEDS a Total Make Over.

And Kevin Padrick Should not make Summit 1031 Exchange the Collateral Damage in ALL this, when the ENTIRE 1031 Exchange Industry is The Real Problem. His JOB, after he stole the JOB is the Fastest way for the VICTIMS to get their Money Back, with Interest NOT Loss... one way to do this is Possibly to SUE the IRS for their Part in ALL this.

When Summit filed for Chapter 11 bankruptcy protection in U.S. Bankruptcy Court in Portland in December 2008, it reported it was owed $13.7 million from Inland.

“The more I think about Inland funds, the more certain I become that without immediate liquidity in the same amount we use, if any word of it gets out we would be ruined,” Lyons wrote in 2005. “I don't necessarily mean immediate financial ruin, but more importantly, our reputations and integrity. That really bothers me.”

So if this is True, and Lane Lyons, Timothy Larkin REALLY thought this was WRONG, unEthical, Illegal in any way... well then Lane Lyons,Timothy Larkin had a duty, an Obligation to Contact the IRS, the department of Justice and to find OUT years ago ... Right?

I am so perplexed, this Red Flag Email alert in the news RIGHT NOW seems to point out that Lyons and Larkins were conspiring to Keep this all a Secret, and that Financial Ruin was not as important to them as their Reputation or Integrity.

That does not really make sense, had they asked authorities back then - they would have looked to have had High Integrity... is the point of the article to Defame and Discredit Lane Lyons and Timothy Larkin OR to Make you Think they were a Squeaky Wheel all along that were not heard and pointing to Other Possibly Fall Guys in the Summit 1031 Exchange Bankruptcy ??
Lyons, Larkin, Neuman and Stevens have not been charged with any wrongdoing.

But Bankruptcy Court documents show the U.S. Department of Justice issued a grand jury subpoena for Summit's records shortly after Summit's bankruptcy filing. The trustee's report also states Summit is under investigation by the FBI and the Internal Revenue Service.

So the IRS is Now Investigating, are you Kidding?

Who are they investigating.. this One Exchange Company... the IRS is Guilty in all this.. had they watched these companies.. all across the land in ANY way... the Real Estate Consumer would not NOW be LOSING everything.

Now they are supposedly so gallant in joining the Department of Justice to INVESTIGATE this ONE incident because gee, this one did not cover their ass so well and lost big money....

What about the Real Estate Consumer doing 1031 Exchanges Right NOW and at this SAME Legal RISK... is there any INVESTIGATION there... ????

“I disagree with much of the verbiage in the report and many of the conclusions,” Lyons said in an interview Thursday. “I worked very hard to alter and stop Summit's practices then, and I've worked since then to repair and mitigate the damages caused by Summit's failures. I sincerely regret my earlier efforts weren't fully successful.”

Ok so starting to Smell a Rat here... hmmm... What? Did Lane Lyons sincerely make earlier EFFORTS to "alter or stop" all this? Are you Kidding??? Did he Call the IRS, the Department of Justice, the FBI .... did he seek outside counsel... did he QUIT.. did he Stomp his Feet and Demand this Supposed Bad Bahavoir "alter or stop" .... What Efforts did Lane Lyons really do.. as he So gallantly tries to NOW stand in the White Light on All this.

Numerous attempts last week to seek comment from the other principals or their attorneys were unsuccessful.

Attention: Andrew Moore - Bend Bulletin, why in the Hell would they give you a COMMENT when you jumble and twist the facts. If you printed with integrity, knew what you were REALLY talking about and reported the REAL news.. the "other principals" would MOST Likely be Readily Available for your Emailed Statement Request....

In the wake of Summit's bankruptcy filing, creditors subsequently filed more than $41 million in claims against the company, making it among the largest bankruptcy filings to come out of the collapse of the housing bubble in Central Oregon.

Kevin Padrick, the court-appointed bankruptcy trustee who authored the report, also accuses Summit in the report of operating a Ponzi scheme. The sentiment was echoed by Judge Randall Dunn, the Bankruptcy Court judge overseeing Summit's case, who said the company “arguably ran a Ponzi scheme” in remarks at a hearing in Portland last May.

If all or Most 1031 Exchange Companies do this Same Standard of Practice, in their daily business in ANY way, if it is shown that OTHER 1031 Companies do the same thing and that Kevin Padrick - the IRS - the FBI - the Department of Justice Know this and have not talked about it or factored it in...

Well One Might Say, in My OPINION that the Summit 1031 Company SHOULD File a Defamation Lawsuit, as yes business went bad - they lost your money - many businesses are going belly up right now - so to RUIN the Individual on False Information and making them some sort of Example when the INDUSTRY is still doing this same kind of BUSINESS as USUALL right now TODAY.. this is WRONG and is Illegal...

If other 1031 Companies have been doing this, and still are and the IRS, FBI and DOJ is ignoring it, well then this Defamation, this Discrimination, this attitude of who can break the laws and who can't based on who you know and NOT fact or Law.. ...

FACT.

I first Read about the Summit 1031 Bankruptcy in my Real Estate Writings about Kalispell Montana Real Estate and the Real Estate Victims that I saw being created by the Summit 1031 Bankruptcy as part of my Real Estate Consumer Advocate Blogs in which I am an Industry Insider and Whistleblower as a Real Estate Broker Owner.

In this I was found in the Search Engines on Summit 1031 by an Ex of Stephanie DeYoung. He had plenty of things to say, and well he gave me a Link to Stephanie's Blog, and what looked like access codes to the blog.. and what looked like inside information on the Summit Case.. so In defending the Real Estate Victims I posted a Daddy's Little Girl Post kind of Slamming Summit and touched on her belief a bit as per the blog.. the email...long story.. from there and before Stephanie Emailed me.. I read the whole email, and I went and read a small part of Stephanie's Blogs as there is an Enormous amount of information there..

I figured that much information, documents and from what I did read that her story was a Big Deal and that as a Real Estate Industry Whistleblower I wanted to learn more about the Inside of a 1031 Company and a 40 Million Dollar Bankruptcy that involved Real Estate Victims..

So I pulled out some of the information and wrote on it and linked to her blog as my source, in that she became under attack by the Bankruptcy Trustee for something she really had nothing to do with..

She emailed me links to internal posts for me to read to further clarify who she really was in all this and I removed my original posts about "Daddy's Little Girl" and other tidbits.. for their truly was a whole lot more to the story...

From this, well I have had tons of information emailed to me on Bankruptcies across the United States.. and just how Corrupt the Bankruptcy Courts are.. from the $30,000 bankruptcy to losing a home and a vehicle to Involving and Using the Bankruptcy Courts to Steal a Trillion Dollar Patent - by the Corrupt Patent Attorney as in the Iviewit Stolen Patent Case ( www.DeniedPatent.com is my Blog on that )

And I have heard a whole lot of stories in the price range in between all involving the questionable oversight of the Department of Justice Trustee, and the Local District Courts, Supreme Courts and the Protected Law Firms in that Particular Area "Attorney Fraternity" .

We know from the Murder of Nancy Bergeson, Oregon Public Defender that Oregon's Attorney Fraternity is Particularly Deadly and they will STOP at nothing to Suppress the Truth.
If there is Any Law that ever was REALLY intended to Protect Industry Whistleblowers of ANY kind - well it had better protect a Woman Like Stephanie DeYoung.

The National Association of Realtors is a Monopolistic Giant that is Above ALL Anti-Trust Laws, and because NAR Lobby's - Huffs and Puffs and Spends Millions a Year (Literally) Lobbying for what is Good for NAR and Bad for Consumers, well NAR is to Big for the Department of Justice to Really do anything to Fight them.

SO they have to cut deals and create illusions.

Now we now that NAR members boycott members who charge less commission, we know that NAR members boycott local Real Estate Magazines that Allow Companies that want to Market a For Sale by Owner... now these Magazines make BIG Money from Real Estate Companies with Lots of Listings SO the Magazine Does What they are TOLD too, Right?

It Violates Anti-Trust Laws TO not let Non-NAR Real Estate Agents, FSBO Marketing Companies or the Sellers themselves market in local real estate magazines. However NAR is above Anti-Trust Laws, meanwhile those BIG Tech Companies like Intel Corp. and APPLE have to pay HUGE fines seems like every year in order to make deal for the Anti-Trust Violations.

Why is the National Association of Realtors protected from all this?

Who is Protecting NAR and How Much are they Paid to Look the Other Way?

NAR acts like, and the Department of Justice seems to blindly believe, or pretend they do, that Realtors don't participate in Anti-Trust Violations and the NAR in no way promotes Anti-Trust Law Violation behavior in their Agent, "Realtors". Yet along with Magazine Boycotts, Boycotting agents that charge less, and blatant "Standard Commission" Practices that REALLY Do happen.....

We also have the, Well if your not a "Realtor" "NAR" member - National Association of Realtors Cartel Member TELL non members they won't show their listings because they are not guaranteed to get PAID - this Greedy behavior ... promoted by NAR is Flat Wrong, and designed to AGAIN force us to be NAR members... the "REALTORS" can show our listings they just won't - all they have to do is submit a Commission Agreement with the Purchase Agreement - that Simple Happens all the Time... yet NAR members tell their Agents and Yammer about it in groups that You won't get PAID don't show her LISTING... WHAT?

Flat OUT Lies brought to YOU by the National Association of Realtors !!!

Now on Top of this THEY make it Almost impossible to SHOW their listings because they are often to Busy to accompany you if your a Buyers agent, which is Really in the Sellers best interest because the Seller's Agent - so they won't go open it for you - or go get the key from the lock box so you can use it - you can't get a "Supra Key" the Magic "Realtor" key if your not a Member - so yet another way that NAR promotes Monopolistic Behavior and Pushes out Real Estate Broker that ARE not Members of the Realtor Club.

Sellers Contributions or Kick Back of Any Kind is Mortgage Fraud, Banking Fraud, Tax Fraud and Creates a FALSE Real Estate Market.

Sellers Kick Back - Sellers Contribution at Closing - Sellers Cash Back

Sellers Giving Buyers Money for Any Reason Creates False MLS Data, and is Fraud on the Banking Industry, I don't Care what your Realtor tells you....

Still the Banking Industry with the Help of the Realtors and I Guess the Mortgage Broker are Convincing Sellers that it is Ok and Legal to to Participate in "Sellers Contributions" or other ways that a Seller Ends up Giving a HUGE amount of Money back to the Buyer.

Oftentimes it is done Like this and The Mortgage Broker Calls it a Sellers Contribution.

The purchase price is Say $200,000 and the offer Comes in at $215,000 and the contract says that the Seller Will Contribute or whatever Wording works good in your area, it is still the same meaning... the Lender takes this as the Buyers Down Payment so they can FORCE the Buyers Loan THROUGH when Really the Buyers Does not have a down payment. Oftentimes this is even given back as Cash the Same Day as Closing, Flat Out CASH to the BUYER and the REALTOR tells the Seller it is Legal. Wonder if the Realtor Gets any Kick Back from Deals Like This? Anyway...

the Lender KNOWS, because the Lender Sees the Buy Sell Contract, they know that the BUYER does not REALLY have the Down payment, so what do they do CHANGE the Contract to Submit it to their Loan Approval Department ?

Appraisers Know, because most ask me for a Copy of the BUY - SELL so they can then make an Un-Biased Objective Market "Opinion" on the Value of Your Home.

So it is Just Matter of Fact, and No one Seems to Be Concerned, or Was ever Concerned that it was Creating "Values" that were not real and people were paying Higher and Higher Prices based on FALSE - MisLeading SOLD Data.

The Motivation - greed of course because these Middle Man Lenders, Mortgage Brokers that Deal With Lenders that Deal with Banks and on and on, often times they Get Commissions for the Life of the Loan which Can REALLY ad UP. The Realtor who pushes the deal gets the One Time Commission... well more on that later.. (there are oftentimes other kick backs)

Sellers Contributing Money to Buyers so they Can Get a Loan is Bad for Comparable SOLD Data, it is Bad for the Fraudulent Bank Loans that Put the Homes Value quite a bit higher, it is Fraud on the banking industry no matter how you look at it, it is Bad for the Seller as they Pay Capital Gains Tax on this Money - most won't mind because it is included in their Free Equity with the Capital Gains Exclusion - which is Still Fraud on Someone.

There is no Rational way to Say it is OK, it is Simply NOT the SOLD Price, and it makes the SOLD Data Wrong which affects the Next Sale. It is FRAUD, no matter what anyone is telling you.

If the only way a Buyer Can Buy a Seller's Real Estates For Sale is if the Seller Fakes a Down Payment so the Lender thinks that the Down Payment is Coming from the Buyer and will therefore give the Loan, Well then the Buyer Cannot Afford the Property and Will eventually Lose it Anyway.

From the Seller's perspective, many take the Deal because they NEED and Want to Sell and they don't worry of the Tax because it is Tax Free money anyway. So the Buyer gets the Property with no money down, and NOT with a NO Money Down Loan... the Lender makes it look like there is a Substantial Down Payment.

Still in 2010 this is Going on, after Trillions in Bank Bailouts Due to the Fraudulent Secondary Loan market, Still the Realtors are in the Field Bringing Contracts that Make it So the Buyer is Getting their down Payment from the Seller. And Shocking but I am Getting Reports that not only is this going on for Down Payments but to actually give Cash Back to the Buyers.

And the Realtors are Telling the Sellers that this is Absolutely Legal. You see the Buyer gets this money the day of Closing, so what in the World would STOP the buyer from taking the Cash Back saving it, staying in the home til' the bank throws them out.

Then After months of Free Rent when Foreclosure finally happens - the Buyer just walks away, Cash Stowed away and Money Ahead. Or the Buyer may use this money for the payments for awhile til' the get on their feet per say. The thing is, that Buyer Could not afford the Home. And this Real Estate Transaction Scenario is bad for the Real Estate Industry and Should be Regulated.

And it all Originates with the Realtor pushing the Deal on the Seller so the Realtor Gets Paid, Now it looks like the Seller gets Paid too. The thing is, in the long run the bottom of the Game Falls out, because it raises the VALUE in the MLS Data and the Next Person to buy, say the house next door, the Appraiser does not know to Compensate 0r Change the Data on SOLD information to "Correct" for a Scam that he did not know about.

So we know that the Seller is Liable for the Extra Money they did not really get, because the Tax Man looks at the Settlement Statement and you Pay based on the Selling Price. Now if there is a 1031 Exchange involved, where does this leave the Seller Kick Back Scam. Well then I guess it would be some sort of Tax Fraud.

Because your Exchanging the $200,000 you REALLY got, but the Paperwork says you Got More then that... how do Realtors Explain that to Sellers. It looks to me like the Realtor just gets loud and Says it is Legal and the Seller Sits down and Shuts up...

Now What about the Buyers Tax Consequences in this Situation?

Well when the buyer goes to Sell the Property. They Paid $215,000 - yet they Really Paid $200,000 so if they sell for $215,000 they have no gain right? But in Reality they Really Do have a Tax Gain. And this is Legal to the Realtor, to all who let this Contract go through... which would include the Title Companies, the Lenders, Banks and Mortgage Brokers?

Also what about the Buyers Income Tax, Well they were Flat out Given $15,000 and they won't claim it because the Seller Claimed it and it was Tax Free, if it was Capital gains to the Seller and not part of their "Exclusion" well then the Seller Paid the Buyers Tax based on Capital Gains when Really it was Income and Income to The Buyer.

Does the Realtor Disclose to the Buyer that when they Sell, their Tax base is $215,000 and not $200,000? From what I see when this situation arises - no one explains - DISCLOSES any of this implications of all of this To Anyone.

No one is Policing the Real Estate Industry, the Ground Level where the real corruption and problem is No One is Looking. And well the Players at that Level they are Just trying to Make a Living and they don't get paid for their Hard Work unless there is a Closing.

So the Pressure To Close the Deal Surpasses the Integrity of the Deal and the Protection of the Consumer gets lost along the way. Meanwhile, the False Values and MLS Data increasingly Becomes False and then SHOCKING now people have loans for more then their real estate is worth. And the Lenders that allowed this Fraud - that Blatantly Allowed Appraisals to Come in High and that allowed Sellers Contribution that Created the Market Collapse - they Get a Bail Out. The Home Owner should Flat Out Get a Debt Reduction.

Lenders, Banks, Local And Federal Governments are Ignoring this is Fraudulent Behavior that affects every aspect of the Real Estate Industry.

This is Fraud Against the Stock Markets based on the Secondary Lending Market, which Let's Face it the Entire Economy is Rooted in the Real Estate Industry and without integrity there, without real values and The Controlling of False Bubbles a Collapse is Un-Avoidable. Never think they did not see it coming, they created it and the socked away plenty of Money for the Cartel at the Top of the Lending Industry.

Realtors in All this, well they Do the Dirty Work. And most just want to Close the Deal and do not look at the big picture of what it is doing to the market. The Realtor, as does the other parties to the Transaction, they just want a pay check.

IT is up to the Regulators of the Real Estate and Lending, Banking Industry to STOP this madness and even in an Economic Collapse and Real Estate BUBBLE Big Time Burst, this Stuff is Still Going on. Oh wait there is No Regulators... and the "Voice of Real Estate" THE " National Association of Realtors" well they don't care and they are NOT interested in Lobbying for things that actually HELP the Real Estate Consumer.

And the Realtor in all this, is Telling the Sellers it is Legal, and So is the Mortgage Broker. And the Realtor is NOT disclosing the Tax Consequences, the Mortgage Fraud Aspects and simply pushing the deal through.... even Right Now Today...

The other thing in common with many of These High Profile - Big Dollar US Bankruptcy Court Proceedings is that there is no real investigation as to where the Creditors, the Real Victims money really is... The Department of Justice seems to really be fully Duped into believing that their US Department of Justice Bankruptcy Trustee is Ethical, and Really is acting with the Highest Fiduciary Duty... when What I am seeing is in Reality That is Just NOT the Case.

YES it would not be in the Courts Hands if it were not for some business phopa or corruption within the original company that went bankrupt. However bankruptcies happen all the time.

Surely there is a Checks and Balances system somewhere that would keep the corruption to a minimul and surely there is some Watchdog Procedure in place to make sure that the US Dept. of Justics Trustee involved does not have a conflict of interest of some kind and that they are Really Acting with the Best Interest of the Creditors in Mind....

Jeff Manning Seems to want the Summit 1031 guys to stay in the limelights as to distract you from the Real Players using your Money RIGHT NOW to make their lives better while you suffer.

While Obsidian Finance, Kevin Padrick and his Cronies seize your property, tie up your money, and Pay themselves incomprehensible amounts of money to do it.. well guys like Jeff Manning would have you believe that Obsidian Finance is just doing their job, and that it is all the Fault of Summit 1031.

Jeff Manning wants Umpqua to "tell on" the Summit 1031 boys in order to see them hurt more by all this.... the thing is Summit 1031 Went bankrupt, it happens, businesses do that .. don't loose site of Who Really has Control of your money and has had for around a year now.

The first time I had a client turn their money over to a 1031 Company and that company tell them they had to leave the money their for 6 months, and that the client got no interest, well I was certainly not impressed at the lack of Consumer Protection in the 1031 Industry. Just as all the ENTIRE real estate industry, there is no real oversight, no really consumer protection of ANY kind and No Way to STOP the Powers that be from Running Over, Violating, Lying to and Walking all over the Real Estate Consumer.

The Point? Well STOP all the 1031 Companies from being able to do this. Use a Friend for a 1031 Exchange, Lobby to Change IRS Laws, Complain to the IRS... Do not sit there and persecute ONE Company when they are ALL doing it. They all make money off of your 1031 Exchange and Really Changes need to Be made in the 1031 Exchange Industry as a Whole.

" Judge releases report on Bend real estate case

Umpqua Bank knew as early as March 2007 that the owners of Bend-based Summit Accommodators were diverting millions of dollars from their clients' accounts to fund their own real estate projects, according to a newly issued report by the court-appointed bankruptcy trustee.

Rather than blow the whistle on what may well turn out to be one of the landmark criminal fraud cases to come out of Oregon's real estate crash, Umpqua kept quiet, continued to reap substantial dividends from the large deposits Summit offered and helped finance some of the real estate projects with $6.3 million in loans, the report claims.

The trustee's report was released by U.S. Bankruptcy Court Judge Randall Dunn Wednesday after the bank fought to keep portions of it secret. It reveals much about the relationship between Umpqua and Summit, including the fact that Umpqua's most senior executives for months considered whether the bank should buy Summit outright.

In the end, bank officials opted against such a deal, suspecting they were being played as "suckers," according to the report. That proved a shrewd move for Umpqua, but it didn't do anything for Summit's unsuspecting customers.

"Umpqua knew that other 'suckers' were readily available: namely (Summit's) new exchange customers who were being signed up and whose money was being put at risk," said Kevin Padrick, the Bend-based trustee, charged with returning as much money as possible to Summit's former customers. "While these 'suckers' unknowingly took the risk that Umpqua Bank was unwilling to take, Umpqua continued to profit by providing services that allowed the (Summit) shareholders to continue their scheme."

Padrick filed a civil lawsuit against Umpqua last summer claiming the bank aided and abetted money laundering.

Umpqua vehemently denies those charges and it fought hard to keep portions of Padrick's report under wraps. John Spencer Stewart, a Portland attorney representing the bank, said repeatedly in U.S. Bankruptcy Court that the Umpqua documents Padrick sought to release were more "strategic" than illuminating.

"They're intended merely to embarrass the bank," Stewart said.

Umpqua has so far succeeded in keeping a host of internal Umpqua documents, that Padrick had hoped to include with his report, out of public view. The battle over the release of the internal bank documents will take place in January.

Summit was a so-called facilitator of 1031 tax-free exchanges, a hugely popular tax strategy. It's role was simply to hold their client's money while they concluded their property exchanges.

Summit moved much of its banking business and more than $15 million in deposits to Umpqua in 2005.

"WOW!!! What a day in Central Oregon," former Umpqua President David Edson raved in a subsequent email to his Bend-area managers. "Keep the pedal to the metal and we'll own Central Oregon."

The relationship grew closer, beginning in May 2006, when the two sides began talking about Umpqua buying Summit.

The talks were still going on 10 months later. On March 2, 2007, the Summit principals met with Umpqua executives, including CEO Ray Davis and Edson and others.

In a memo to the gathered bankers, Summit executive Lane Lyons delivered a bombshell. Instead of holding its clients' money in highly liquid short-term accounts, Summit had invested about 17 percent of it in a variety of "local real estate ventures and businesses."

The investments "allowed Summit founders to build substantial net worths ..." the memo stated.
The Lyons memo disclosed one more bit of big news: the real estate investments had put the company in a cash-flow pinch. Summit proposed that an acquisition or injection of capital by Umpqua could solve that problem.

Some Umpqua executives were underwhelmed with Lyons' pitch. Brad Copeland, Umpqua chief credit officer, said in an email, "This is just nonsense and the guy is clearly desperate."

It's not clear how serious Umpqua ever was about acquiring Summit. The two sides had periodic meetings as late as the fall of 2008, when the real estate crash was well underway and Summit executives desperately tried to fend off disaster.

By late in the year, some bank officials were speaking the obvious -- that linking up with a company that for years had been helping itself to its clients' money was a terrible idea.

Bob Campo, a bank employee, predicted in a Dec. 6, 2008 email that Summit would get mired in civil litigation if it failed to produce its customers' cash.

"Do we want to be even on the periphery of this world," Campo asked, "much less enter into some of equity position that may entangle us in their business issues?"

But Umpqua already was entangled to some degree. It had loaned more than $6 million to various individual real estate projects headed by Summit principals and it was earning nice profits on Summit's deposits, which ultimately grew to more than $78 million.

Thirteen days after Campo wrote that email, Summit filed for bankruptcy. Customer lost $29 million, Padrick said.

"I'm sure glad we didn't get into bed with these guys," Copeland said in a subsequent email to bank CEO Davis. "I suspect there are some significant fraud issues involved and our records will be subpoenaed. This will probably get very ugly."

On Thursday October 28, 2009, The Law Offices of David H. Relkin, on behalf of Donna A. Sturman, applied to retiring Bankruptcy Judge Prudence Beatty, to have the Court “finally do justice” and order JP Morgan and the Trustee to turn over Millions of Dollars of stolen assets—which the Judge flatly denied by claiming Donna “had no standing.”

This case is virtually a tale ripped from the pages of the Trustee’s Manual of Bankruptcy Fraud and Abuse.

On Thursday, the Court having never required an accounting of his collections and distributions in the case, the Trustee finally disclosed that he had taken in over $41 Million Dollars, still leaving the mystery of where the money went, although most of it found its way into the coffers of JP Morgan.

Prior to the Bankruptcy, the Bank chased after Donna’s brothers to lend them Millions for a hostile takeover of The Cooper Companies, Inc. and, due to its theft of assets, JP Morgan is now one of Cooper’s largest shareholders.

Once the Bank became aware that, what the brothers called their silent partner, Donna Sturman, had commenced an action against them for waste, dissipation and fraudulent transfers of the Sturman Family properties, which were being used by the brothers as their private piggy bank, the Bank frantically began illegally acquiring security interests in the Family assets to secure the brothers’ personal loans with property owned by their sister, including the Southeast Corner of 86th Street, leaving the properties empty shells.

In furtherance of its unlawful conspiracy, the Bank then filed Bankruptcy Petitions against Donna’s three brothers, and installed its handpicked Trustee and law firms, who were counsel the Bank as well as all the other major creditors in the Bankruptcy—which conflict of interest, under the Bankruptcy Code, requires disgorgement of the attorneys’ enormous fees.
Thus, the Bank was able to play both sides of the table by making all the major decisions in the Bankruptcy, while its own officers negligently left a trail of brazen correspondence of the Bank’s collusive and corrupt instructions to the Trustee.

Judge Beatty repeatedly approved the Bank’s unlawful acquisition and sale of non-debtor assets, allowing her Court to satisfy fraudulent claims over a 20 year period.

Under her supervision, the Bank, the Trustee and his law firms were able to rape the assets of the Sturman Family—none of which were in bankruptcy—and to line their pockets with millions of dollars of stolen money.

Judge Beatty blatantly and improperly dismissed Ms. Sturman’s action against the Bank for “lack of prosecution,” after the action was fully briefed, while keeping in place an injunction prohibiting Donna from taking any discovery of the Banks.

The complicity in fraudulent conduct did not stop there during this 20 year old case (perhaps the longest running bankruptcy in New York).

Although the US Trustee was repeatedly advised and supplied with evidence of these crimes, it inexplicably sat on its hands, despite its legal obligation to supervise and investigate Trustee misconduct.

To force the brothers to help the Bank go along with its embezzlement, it threatened the brothers with criminal prosecution, and after the Bank got it, had the brothers indicted anyway for submitting false financials, spending thirteen months in federal prison. Unsurprisingly, the Bank officers testified with immunity.

Despite Orders obtained by Donna preventing sales of the properties, the Trustee was allowed by Judge Beatty to simply ignore them, allowing one of the most valuable assets of the Sturman Family Enterprises to be “abandoned” so the Bank could acquire the property for free without using up any of its debt—a lender fraud called “double dipping.”

The Bank and its hand-picked Trustee then took control over the other non-bankrupt properties, used them as cash cows, and after bleeding them dry, sold them for the asking to third parties (including one by the Trustee to his own employee) while the Trustee took in $1.0 Million Dollars a year for seven years on just one property.

Where the money went is still a mystery.

The United States Trustee Program is a component of the Department of Justice that, according to its website, “seeks to act as the watchdog over the bankruptcy process to protect the integrity of the Federal bankruptcy system.”

In addition the Department of Justice has the responsibility to ensure compliance with applicable laws and procedures and to identify and investigate bankruptcy fraud and abuse in coordination with United States Attorneys and the FBI.

The Attorney General is charged with the appointment of United States Trustees and Assistant United States Trustees.

On Thursday, after Judge Beatty awarded the Trustee a cumulative amount of over $8 Million Dollars in fees to him and his law firms (which Judge Beatty fittingly called “Blood Money”), Judge Beatty characterized the negligent failure of the Trustee to do anything in the Bankruptcy case for the last ten years by saying, “I understand how busy people can get.”

It is counsel’s opinion that such award of fees was a transfer of stolen money.

In attempting to fight Judge Beatty’s indifference to the criminal activities committed in her Court, Donna retained Helen Chaitman, who coined the phrase “lender liability” but who, like so many of Donna’s attorneys walked away when Donna’s money ran out.

So “successful” in their control of the Bankruptcy, the Bank and the Trustee blocked all of Donna’s income, forcing the heiress to be locked in handcuffs by Judge Beatty, evicted over seven times with her three young children, once in the middle of a winter blizzard, and then thrown into a fraudulent bankruptcy by one of her own law firms whose debt to the Bank was wiped off the books.

Once forced into Bankruptcy, Alan Nisselson, who now supervises the Madoff Bankruptcy, was appointed as Donna’s Trustee to clean up Ms. Sturman’s dangerous claims once and for all.

Without any notice to Ms. Sturman, he settled all of Donna’s claims in the brothers’ bankruptcy in a collusive and illegal agreement in which the Trustees even released each other—a violation of law and the Code of Professional Responsibility—which settlement was immediately rubber-stamped by Judge Beatty.

Mr. Relkin is now analyzing the case in order to determine what appropriate actions to take to vindicate Ms. Sturman’s rights.

Am I on a Crusade against the Realtors?

I am simply telling you what I experienced as a Real Estate Broker Owner and as a Designated Realtor for my Own Real Estate Company for near a Decade. This experience was across several states and in various MLS Data Bases and Realtor Associations.

I am not on a Crusade against the individual Realtor. It is about accountability of NAR, I was one of those Individual Realtors and had no Real Way to protect the Real Estate Consumer and NAR at any Level NEVER backed me up on wanting to do right by my Real Estate Consumer. NAR did not stand up for me against unEthical Realtors and NAR lobbys for E and O insurance to be mandatory, and actively fights for the rights of Realtors to make money in the real estate transaction but does not take a REAL active role in what is REALLY best for the Real Estate Consumer.

Commission based real estate is NOT good for the Real Estate Consumer. It being unethical to involve a 3rd Realtor in your Real Estate Transaction as a Consult is seriously anti-consumer. E and O insurance is One hundred percent anti-consumer yet NAR member sit in front of State Governing bodies and tell officials that E and O helps protect consumers as well as Realtors... Not True.. not even a little bit True. And as Usual the National Association of Realtors is NOT accountable for any LIE they tell no matter how big it is or who is hurt by it.

Most Realtors in the Real World of Real Estates Are Good, Honest People and just want to sell you a house or sell your real estate and move on about their life. However, NAR will not protect those good Realtor. NAR will not stand up for the consumer against a Realtor that lies or breaks the law, they simply let the courts figure it out. And the E and O insurance paid Real Estate Attorney keeps you in court until you Break.

There is Currently NO Consumer Protection in Real Estate. And when the Good, Honest Realtor stands up for the consumer they are beaten down, boycotted, shut out, ignored and well they have no way to survive in the Real Estate industry and all because they spoke out about the Bad Realtor who hurt the consumer. ANOTHER BIG QUESTION- Why did Sussman Shank rollover and vote Padrick & Obsidian in when they were the one's who counseled Summit Principals to hire Terry Vance as CRO? Can't tell you, but I did hear that Susan Ford, their lead attorney, was out of town when their minds changed. THERE ARE SO MANY BIG QUESTIONS- Why did Perkins Coie let a Summary Judgment go through that has absolutely NO TEETH for the creditors' committee - their own clients? You tell me. Seems like the attorney's are making a BOATLOAD, $2 Million already, for absolutely no protection of their OWN CLIENTS rights.

How did I get involved in this?

First Reason - My Dad (Mark Neuman), Brian Stevens, Lane Lyons, & Tim Larkin are good men that were following the regulations set forth for their business and now they lost everything.

My dad worked very hard for many years, helped everyone in the Bend Community, and cares very deeply about others and their well-being was being looked at like a criminal for following the rules and regulations of 1031 exchange companies. Everyone was happy when Summit 1031 helped them save taxes. Now he is being looked at like a criminal - well he has done nothing like Kevin Padrick. He never intended to not have your money available.

Brian Stevens & my dad put their personal real estate up as security for Inland, just to put their partners, Tim Larkin & Lane Lyons, at ease. The bulk of the Inland loans were in various real estate investments related to Mark & Brian. So they both put did $5 million trust deeds and secured it with almost all of their property (none of which had Inland debt- at least not the property dad had).The FBI was chasing the $10 million for a couple months. They, of course, found the trust deeds and immediately concluded that the $10 million was in a Swiss bank account. Not sure what you think, but why would someone record a trust deed to steal money and send it to a Swiss bank account?? Soooooo.......

Second Reason - There are 106 Innocent Parties who are also suffering from the Bend economic crash, but now have to deal with someone who wants to bully them, force them to use their cash (Summit 1031 Exchanger assets) to protect the investments for being taken by Obsidian and from going into foreclosure (LOSING Summit 1031 Exchanger value).

The following is my list of what I call "list of atrocities" which include all of the things these highly compensated professionals are charging Summit 1031 Exchangers $112K to do with no value for the Summit 1031 Exchangers. For more detail go to my site:

Obsidian Finance seized another bank account Monday! Obsidian Finance sends letters to Renters for them to send their rent checks to them, while the 106 Innocent Parties are having to pay the debt service payments and operational expenses. Well, guess what, they won't be able to keep up for long, forcing the properties into foreclosure. Then my guess is that Padrick's friends (if that is what you call them) will buy these properties at discounted prices from the banks. Later to end up with the Windfall when the economy comes back!

Well these 106 Innocent Parties put their hard earned money into these investments, they take care of them, and they pay the bills. I see this as Legal Extortion, but according to Judge Dunn these properties are not in his Jurisdiction even though his court allowed for the transfer of the Summit Principal's interests to be transferred to Kevin Padrick. Doesn't Judge Dunn know Kevin Padrick's track record or has he been duped too?

Third Reason - I got the notice on the Attorney & Professional fees in this case and was dumbfounded. I decided to go through Obsidian Finance, Kevin Padrick, and Tonkon Torp's fee applications and I found a ton of OVER BILLING for NO VALUE. Supposedly the Court is supposed to monitor this, but so far I haven't seen the court monitor anything on this case. It is my opinion that the Court has put your Money and Value in jeopardy and is not doing their job to protect it. There are 100 Summit 1031 Exchangers losing their money!!!

Why is it that Summit 1031 exchangers are footing the $2 Million Dollars of Attorney Billings when my opinion is that none of these "professionals" are watching out for their best interest? They tell me that the Court (Judge Dunn), the US Trustee (Robert Miller, Pamela Griffith, Vivienne Popperl), and the bankruptcy or liquidating trustee (Kevin Padrick) that they are supposed to act in the HIGHEST FIDUCIARY DUTY, which means...

A fiduciary duty is a legal most commonly a fiduciary or trustee and beneficiary. One party holds a fiduciary relation or acts in a fiduciary capacity to another, such as one whose funds are entrusted to it for investment. In a fiduciary relation one person justifiably reposes confidence, good faith, reliance and trust in another whose aid, advice or protection is sought in some matter. In such a relation good conscience requires one to act at all times for the sole benefit and interests of another, with loyalty to those interests.

A fiduciary is someone who has undertaken to act for and on behalf of another in a particular matter in circumstances which give rise to a relationship of trust and confidence.

A fiduciary duty is the highest standard of care at either equity or law. A fiduciary is expected to be extremely loyal to the person to whom he owes the duty (the Summit 1031 Exchangers): he must not put his personal interests before the duty, and must not profit from his position as a fiduciary, unless the (Summit 1031 Exchangers) consents.

In English common law the fiduciary relation is arguably the most important concept within the portion of the legal system known as equity. In the United Kingdom, the Judicature Acts merged the courts of equity (historically based in England's Court of Chancery) with the courts of common law, and as a result the concept of fiduciary duty also became usable in common law courts.

When a fiduciary duty is imposed, equity requires a stricter standard of behavior than the comparable tortious duty of care at common law. It is said the fiduciary has a duty not to be in a situation where personal interests and fiduciary duty conflict, a duty not to be in a situation where his fiduciary duty conflicts with another fiduciary duty, and a duty not to profit from his fiduciary position without express knowledge and consent. A fiduciary cannot have a conflict of interest. It has been said that fiduciaries must conduct themselves "at a level higher than that trodden by the crowd"[2] and that "[t]he distinguishing or overriding duty of a fiduciary is the obligation of undivided loyalty."[3]

I am just not seeing how this Court, the US Trustee's Office, Kevin Padrick are at all maintaining their FIDUCIARY DUTY to the SUMMIT 1031 EXCHANGERS. Do you see it?? BUT MOST IMPORTANTLY - DID YOU APPROVE IT?

My "list of atrocities" alone should show that Kevin Padrick and Obsidian Finance are not acting with a "stricter standard of behavior than the comparable tortious duty of care at common law". WHY ISN'T HE ACCOUNTABLE TO THIS SO CALLED FIDUCIARY DUTY?

Why is Kevin Padrick and his Attorney Fraternity stand to make a 10% success fee based on claims racked up?

Why is Kevin Padrick's company, Obsidian Finance, going to make 15% off the sales of property? A normal trustee usually only makes 1%.

I see a ton of profit making for Kevin Padrick and Obsidian Finance - DON'T YOU???

Realtor becomes Squatter - Realtor has Squatters Rights in Florida Apparently and NAR, they Don't Care.

A story of Squatter Rights in Florida.

Squatters rights sound sick indeed, I guess every state is different. In Montana I had this happen and the local judge said to post a 24 hour notice, and then you could go in after that with a cop to take possession.

I know there are laws about living on a property Adversely where you can somehow file title after 5 years. Sick but true.

However, today we have a story from Florida where a Realtor has changed the locks of a Eldery man's home, and she is living in the home. She claims squatters rights, has moved in others and has big dogs.

This is a Perfect example of NAR standards, now how does a Non-Realtor file an Ethics Complaint against a Realtor, well they don't really. Who helps Real Estate Consumers in situations such as this? Well I am use to NAR, and the local Realtor Associations doing Nothing. We are about to find out if Florida Senior Advocates, Elder Abuse Advocates, Florida Real Estate Regulators, NAR, Florida Association of Realtors or anyone Really will help these folks to GET this Realtor out of this home.

HERE is the STORY as Sent to ME

I found out today that I have a dear friend in trouble (Marge)- the woman volunteers for The Society of St. Vincent DePaul (our mission is to provide all kinds of help to those in real need), she is retired and a good friend of my family.My mother and she are neighbors in a gated community in Naples, Florida. Long story short - they are neighbors of a man who was diagnosed with stage 4 bone cancer.

He is British and wanted to return to England to live out what time he has left. He hired a realtor from Downing Frye to sell his home.

The realtor allegedly asked the owner if she could Live in the house while she showed it???? He supposedly said yes. She has no lease- she pays no rent.

She apparently neglected to tell him that she was bringing along at least two other people and three large dogs. Marge and other neighbors called the owner - who asked the realtor to leave.

She promptly told them that she has squatter's rights and needs notice. When the squatters rights for Florida scenarios was checked out - they found out that she was right and could be in the house anywhere from 3 mos. to a year and has to be served official papers and given ample time to be evicted.

Apparently this past weekend - Marge and another neighbor found out that this realtor had changed all of the locks on the premises and rearranged all of the furniture and the house. They informed the owner.

He asked Marge and Nancy to please change the locks (he is still in England with bone cancer)They saw that a back window was open - (they both had original keys to the house since they had cared for it before) .

They called the locksmith and had the locks changed.

The squatter/realtor comes home. Calls the police - tells police that someone broke into the house and stole valuable items including all of her jewelry. One cop sided with Marge and Nancy - the other with said realtor.

She is pressing charges for breaking and entering and theft. Nancy and Marge are each meeting with attorneys tomorrow.

Marge is 74, a wonderful person, and very upset.

Are there not rules against realtors becoming squatters? Is that not a conflict of interest? What would give her any incentive to sell the house at all? Paying no rent, very nice home, gated community with a beautiful clubhouse and other amenities? Is that not ground to lose a license?

I know there are squatters and the situation is getting worse because of all of the vacant houses - but this woman misrepresented herself - she said she was a realtor (and is)but took advantage of a client and under false pretenses - who is suffering through the last of his life with a very painful disease.

PORTLAND, Ore. -- Holders of More Than 55% of Shares Provide Agent Designations to Call Meeting to Consider Proposals Advanced by Obsidian and Campbell
Obsidian Finance Group, LLC, a private equity firm and The Campbell Group, LLC, a timber investment management company today announced that they are very encouraged by the positive response to their solicitation, having received GOLD agent designations from holders of more than 55% of the shares of Longview Fibre Company (NYSE: LFB) as of 1:00 p.m. ET today.

Obsidian and Campbell solicited the agent designations for the purpose of calling a special meeting at which Longview Fibre shareholders could communicate their interest in having Longview's Board of Directors engage in discussions regarding the Obsidian/Campbell proposal to acquire the company in an all-cash merger and in declassifying the Board of Directors.
Longview Fibre had previously scheduled a special meeting for September 12, 2006 in response to Obsidian and Campbell's filing of a definitive solicitation statement with the Securities and Exchange Commission in connection with their solicitation of agent designations.

The agent designations received by Obsidian and Campbell are being sent to Longview Fibre today, along with a formal demand for the special meeting that indicates the September 12 meeting date would be acceptable.

Obsidian Senior Principal David Brown commented: "We want to express our appreciation to the many shareholders who took the time to complete and return the agent designation cards to call the special meeting. We believe these shareholders are sending a clear message to the Longview Fibre Board. We are very pleased with such tremendous support, especially after the company announced that it had already set a date for a special meeting - a move which could have made shareholders less interested in completing the agent designation cards."

On June 28, 2006, Obsidian and Campbell submitted a new proposal to the Board of Directors of Longview Fibre which increased their all-cash proposal to acquire the Company to $20.51 per share, assuming that the shares to be issued by the company in the upcoming special distribution announced are issued at a value of not less than $20.51. The increased proposal equates to a pre-distribution price of $28.05 per share.

Brown continued, "We know that many shareholders have contacted the company and we want to encourage Longview Fibre's Board of Directors to hear their shareholders' requests and meet with us to discuss our proposal. Thus far, the company has not responded directly to our increased offer. We encourage the Board to meet with us to discuss our proposal and allow diligence in advance of the September 12 meeting."
